Vibe Video provides AI-powered creative tools, including but not limited to:

  • AI Video Generator (Image-to-Video and Text-to-Video)
  • AI Image Generator
  • AI Image Editor
  • AI Logo and Poster Maker
  • Virtual Try-On

Our AI tools are designed for creative and entertainment purposes. You are solely responsible for ensuring that your use of the Service complies with all applicable laws in your jurisdiction.

3. Age Requirement and Eligibility

3.1 Minimum Age

You must be at least 18 years old to use our Service. By using Vibe Video, you represent and warrant that you are at least 18 years of age. We reserve the right to request proof of age at any time and to terminate accounts of users who are found to be under 18.

3.2 Account Creation

You may need to create an account to access certain features. You must provide accurate and complete information during registration.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Prohibited Content and Conduct

The following categories of content are strictly prohibited. You agree NOT to use Vibe Video to create, upload, or distribute:

4.1 Content Involving Minors (Zero Tolerance)

  • Any content depicting, suggesting, or referencing minors (persons under 18) in a sexual, suggestive, or inappropriate context is absolutely prohibited. This includes AI-generated, fictional, or cartoon-style depictions.
  • Content using keywords, descriptions, or imagery associated with minors in any adult context.
  • This is a zero-tolerance policy. Violations will result in immediate and permanent account termination, forfeiture of all credits and payments, and reporting to law enforcement authorities.

4.2 Celebrity and Public Figure Content

  • Content that uses the name, likeness, or image of any real celebrity, public figure, or identifiable individual without their explicit, documented consent.
  • AI-generated deepfakes, impersonations, or synthetic media depicting real, identifiable persons.
  • Content intended to create a false impression that a real person participated in or endorsed the generated content.

4.3 Portrait Rights and Non-Consensual Content

  • Content that uses the likeness, face, or identifying features of any real person without their explicit consent.
  • Non-consensual intimate imagery of any kind, whether real or AI-generated.
  • Content intended to harass, defame, embarrass, or harm any identifiable individual.

4.4 Other Prohibited Content

  • Non-consensual sexual content: Depictions of rape, sexual assault, forced acts, or any non-consensual sexual scenarios.
  • Bestiality: Any sexual content involving animals.
  • Incest: Any sexual content depicting incestuous relationships.
  • Extreme violence: Gore, torture, mutilation, or "snuff" content.
  • Human trafficking and exploitation: Content promoting or depicting trafficking, slavery, or exploitation.
  • Hate speech and discrimination: Content promoting hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
  • Illegal activities: Content promoting terrorism, violence, drug manufacturing, or other criminal activities.
  • Intellectual property infringement: Using copyrighted materials without authorization.
  • Misinformation: Content designed to deceive the public, including political propaganda or election interference materials.

4.5 Content Moderation and Enforcement

  • We employ automated prompt filtering systems and third-party content moderation services to detect and block prohibited content before generation.
  • We reserve the right to review, flag, and remove any content that violates these Terms.
  • Violation of Sections 4.1 through 4.4 may result in: immediate account termination, forfeiture of all credits and payments, reporting to law enforcement, and legal action where applicable.
  • Users who repeatedly attempt to circumvent our content moderation systems will be permanently banned.

5. User Responsibilities

5.1 Lawful Use

You agree to use the Service only for lawful purposes and in compliance with all applicable local, national, and international laws and regulations.

5.2 Uploaded Content

When you upload images or other content to our Service (e.g., for Image-to-Video generation), you represent and warrant that:

  • You own or have the legal right to use the uploaded content.
  • The uploaded content does not infringe on any third party's intellectual property rights, portrait rights, or privacy rights.
  • Any persons depicted in uploaded images have given their consent for the content to be used in AI generation.
  • The uploaded content does not depict minors in any context that could be considered inappropriate.

5.3 Responsibility for Generated Content

You are solely responsible for the content you generate using our AI tools. We do not claim ownership of your generated content, nor do we assume liability for how you use or distribute it. You agree not to use generated content in any way that violates these Terms or applicable law.

6. Intellectual Property

6.1 Our Content

All content, features, and functionality of Vibe Video (including but not limited to text, graphics, logos, software, and AI models) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 User-Generated Content

You retain ownership of content you create using our Service, provided it complies with these Terms. By using our Service, you grant us a limited license to store and process your content solely for the purpose of providing the Service.

7. Payment Terms

7.1 Pricing

We offer both subscription plans and one-time credit packages. All prices are displayed in the applicable currency at the time of purchase. Prices are subject to change with notice.

7.2 Payment Processing

Payments are processed securely through our authorized payment processor(s). By making a purchase, you agree to the applicable payment processor's terms of service. We do not store your full credit card information on our servers. All payment transactions are encrypted and processed in compliance with PCI-DSS standards.

7.3 Billing Descriptor

Charges from Vibe Video may appear on your bank or credit card statement under the billing descriptor associated with our payment processor. If you do not recognize a charge, please contact our support team before initiating a chargeback with your bank.

7.4 Automatic Renewal

Subscription plans automatically renew at the end of each billing period unless cancelled before the renewal date. You will be notified before each renewal.

7.5 Currency and Taxes

All prices are listed in USD unless otherwise specified. You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

8. Cancellation and Refund Policy

Summary:

  • You may cancel your subscription at any time.
  • Refund eligibility is based on usage and time since purchase.
  • Refund requests must be submitted within 14 days of purchase.
  • Accounts terminated for policy violations are not eligible for refunds.

9. Credits and Usage

9.1 Credit System

Our Service operates on a credit-based system. Different features consume different amounts of credits as displayed in the application.

9.2 Credit Expiration

  • Subscription credits reset monthly and do not roll over to the next billing period.
  • One-time purchase credits do not expire.

9.3 Credit Limitations

Credits are non-transferable and may not be resold or exchanged for cash.

10. Content Reporting and Removal

10.1 Reporting Violations

If you encounter content generated through our Service that violates these Terms or applicable law, please report it immediately through our Contact page.

10.2 Content Removal Requests

If you believe that content generated through our Service infringes on your rights (including portrait rights, privacy rights, or intellectual property rights), you may submit a removal request through our Contact page. We will investigate and respond to valid requests within 5 business days.

10.3 DMCA and Takedown Notices

We comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyrighted work has been infringed, please submit a DMCA takedown notice to us via our Contact page.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

  • The Service will be uninterrupted or error-free
  • Results from using the Service will be accurate or reliable
  • Any defects will be corrected
  • Generated content will be free from any issues or claims

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, VIBE VIDEO SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Any damages arising from your use or inability to use the Service
  • Any claims by third parties related to content you generate using the Service

Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Vibe Video and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights (including portrait rights and intellectual property rights)
  • Content you create, upload, or distribute using our Service
  • Any claim that your generated content caused damage to a third party

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. Termination

15.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

15.2 Termination by Us

We may suspend or terminate your account immediately if:

  • You violate these Terms (especially Sections 4.1 through 4.4)
  • You engage in fraudulent or illegal activity
  • You attempt to circumvent our content moderation systems
  • Your use poses a risk to other users or our Service

15.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our data retention policies. No refunds will be issued for accounts terminated due to policy violations.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Vibe Video.

16.2 Severability

If any provision of these Terms is found invalid, the remaining provisions shall continue in effect.

16.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

You may not assign your rights under these Terms without our prior written consent.
